Eminem vs. Apple.... Round 2

Eminemjobs Rapper Eminem and his publishing company sued Apple in 2004 to stop the company from using his song "Lose Yourself" in a commercial for the iTunes music store (the suit was settled and the song was later used in another iTunes commercial.)

Now, it appears as if Slim Shady once again wants to butt heads with Saint Stevie.

According to a Detroit newspaper, Eight Mile Style and Martin Affiliated filed suit because the iTunes music store has allegedly been selling Eminem's music without the permission of either Eminem or Eight Mile Style/Martin Affiliated.

The Detroit News reports that not only is Apple running the songs without permission, but the company was contacted and asked to remove the music and refused. Apple has a deal with Eminem's distributor, Universal Music, that allows it to sell the label's music on the iTunes Music Store.

It would seem that Eminem's beef here would be with Universal and not with Apple, and that's where this could be an interesting case. Does the artist/publisher have a right to demand the removal of their material from a certain retailer, or is it exclusively the call of the distributor?
